Terms & Conditions

Terms of use, commercial engineering services, and website conditions.

1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Australian Dust & Fume Control Pty Ltd (ABN 53 103 245 801, “ADFC”, “we”, “us”, or “our”) website, as well as the commercial supply of engineering designs, turnkey dust collection systems, fume filtration units, wet scrubbers, and associated installation services.

By accessing our website or engaging ADFC for equipment or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must discontinue use of the website and notify ADFC prior to contract commencement.

2. Nature of Website Information & Engineering Advice

The information, diagrams, equipment sizing guides, and technical specifications published on this website are provided for general commercial and introductory informational purposes only. While ADFC endeavours to ensure all website content is accurate and up to date, it does not constitute formal engineering design advice.

Customized dust extraction and fume control systems require site-specific airflow calculations, duct velocity modeling, and hazardous area classification assessments. Binding engineering recommendations are provided exclusively via written proposals signed by authorized ADFC engineers.

3. Quotations, Pricing and Orders

  • Validity Period: Written quotations issued by ADFC remain valid for thirty (30) calendar days from the date of issue unless explicitly stated otherwise in writing.
  • Pricing: All quoted prices are expressed in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless specifically indicated.
  • Variations: Quotations are formulated based on information and site parameters supplied by the client. Any changes to airflow requirements, machinery layouts, duct lengths, or structural access during project execution will be subject to formal written variation orders.
  • Order Acceptance: A contract is formed upon ADFC issuing written order confirmation or commencing fabrication upon receipt of an approved purchase order and initial deposit.

4. Intellectual Property Rights

All intellectual property rights associated with this website and ADFC engineering deliverables—including but not limited to CAD drawings, 3D models, fabrication schematics, technical documentation, branding, logos, photographs, and software sequencer logic—remain the exclusive property of Australian Dust & Fume Control Pty Ltd.

Clients are granted a non-exclusive, non-transferable license to utilize supplied drawings solely for the operation and maintenance of the specific system installed. No part of our designs may be copied, reverse-engineered, reproduced, or transferred to third-party fabricators without prior written authorization from ADFC.

5. Fabrication, Delivery and Site Installation

  • Delivery Estimates: Delivery and manufacturing lead times are estimates provided in good faith. ADFC is not liable for indirect losses resulting from freight delays, supplier component lead times, or adverse site conditions beyond our reasonable control.
  • Site Access & Preparation: Where ADFC is contracted for site installation, the client is responsible for providing safe, clear, and unhindered access to the installation area, certified electrical isolations, clear floor paths for crane/boom lifts, and required site safety inductions in accordance with SafeWork Australia standards.
  • Storage: If a client requests delay of delivery after equipment fabrication is complete, storage charges may apply after fourteen (14) days notice.

6. Title and Risk

Risk of loss or damage to supplied equipment passes to the client upon physical delivery to the client site or collection by the client carrier. Title and ownership of all equipment, ducting, and components remain with ADFC until all invoiced amounts, including any variation charges, have been paid in full.

7. Warranties and Australian Consumer Law

ADFC warrants that fabricated dust and fume extraction equipment will be free from defects in materials and workmanship for a period of twelve (12) months from the date of practical commissioning or fourteen (14) months from delivery, whichever occurs first.

This warranty is subject to the equipment being operated within design specifications, maintained in accordance with ADFC operation manuals, and serviced with genuine filter elements. Nothing in these Terms excludes, restricts, or modifies any statutory guarantees or rights conferred under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law).

8. Limitation of Liability

To the maximum extent permitted by Australian law, ADFC shall not be liable to the client or any third party for any indirect, special, incidental, or consequential damages—including loss of production, loss of profits, facility downtime, or business interruption—arising out of or in connection with the supply, installation, or failure of any equipment.

9. Governing Law and Jurisdiction

These Terms and Conditions, and any commercial contracts arising between ADFC and its clients, are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
